We have received your letter regarding the legal application of Article 18, Paragraph 2 of the Implementation Regulations of the Government Procurement Law (Shen Cai Gou Han [2015] No. 2282). After research, we hereby reply as follows:

In order to promote fair competition in government procurement and strengthen the implementation and supervision of procurement projects, Article 18 of the Implementation Regulations of the Government Procurement Law of the People's Republic of China stipulates that "except for single source procurement projects, suppliers who provide overall design, specification preparation, project management, supervision, testing and other services for the procurement project shall not participate in other procurement activities of the procurement project." Among them, "other procurement activities" refer to procurement activities other than providing overall design, specification preparation, project management, supervision, testing and other services for the procurement project. Therefore, the same supplier can simultaneously undertake the overall design, specification preparation, project management, supervision, testing and other services of the project.
